Основные этапы Покупка недвижимостиmain (Compravendità) 

1. ПРЕДЛОЖЕНИЕ О ПОКУПКЕ (Proposta d’Acquisto)

Первым шагом после определения Вашего идеального дома это сделать предложение о покупке, в письменном виде на имя продавца и заплатить небольшую сумму, как правило, чеком (выписанным на продавца), который будет сохранен у агента по продаже недвижимости.

Агент по продаже недвижимости заполнит соответствующую форму в Вашем присутствии, включая все Ваши условия, касающиеся продажи.

Если продавец примет Ваши условия (письменное согласие), стороны будут связаны для осуществления продажи, как было установлено в предложении. Продавец возьмёт чек, и это становится Вашим депозитом (caparra confirmatoria) на недвижимость. Если продавец не принимает Ваше предложение, агент по продаже недвижимости вернет чек Вам обратно. С этого момента Вы свободны от покупки, или же Вы сможете сформулировать новое предложение в том же порядке, описанном выше.

ПРИМЕЧАНИЯ:

  • Если Вы выйдете из процесса покупки, после того когда Ваше предложение будет уже принято, то Вы потеряете Ваш депозит (пред-оплату). Если, с другой стороны, продавец выйдет из продажи, он должен будет вернуть Вам Ваш депозит и заплатить Вам такую же сумму, в качестве наказания.
    Когда Вы сделаете предложение продавцу, Вы должны также указать даты, когда Вы хотели бы подписать предварительные и окончательные контракты. Эти даты считаются конечными сроками, но Вы можете подписать контракт и раньше указанного срока, если продавец будет согласен с этими датами.

2. ПРЕДВАРИТЕЛЬНЫЙ КОНТРАКТ КУПЛИ-ПРОДАЖИ (Compromesso)

Compromesso - предварительный контракт купли-продажи это соглашение, по которому обе стороны обещают заключить будущий контракт (нотариальный акт) и в котором они регистрируют и обговаривают все условия предполагаемой покупки.

В compromesso следующая информация должна быть четко указана - идентичность обеих сторон, особенности и кадастровые данные о недвижимости, стоимость и способ платежей, и срок, к которому обе стороны согласны подписать заключительный акт (когда недвижимость официально становится собственношстью покупателя).

Также должно быть указано, что недвижимость будет продаваться без каких-либо долгов, обременений или ипотечных кредитов и в полном порядке с правилами градостроительства.
Последующая оплата производится продавцу, как правило, около 20% от общей стоимости покупки (включая ранее оплаченный депозит).

ПРИМЕЧАНИЯ:

  • На этом этапе, Вам нужно будет приобрести итальянский налоговый кодекс (codice fiscale), который можно получить в любом налоговом управлении Италии или в итальянском посольстве.
  • Оплата агентству недвижимости должна будет быть выплачена по подписанию compromesso, как правило, около 3% от стоимости покупки + НДС.
  • Также желательно открыть итальянский банковский счет на данном этапе, в рамках подготовки к заключительному акту.

3. НОТАРИАЛЬНЫЙ АКТ (Rogito Notarile)

Нотариальный акт является Заключительным актом продажи и подписывается в присутствии нотариуса (notaio) и заинтересованных сторон (продавца и покупателя).

Перед подписанием, нотариус выполняет все соответствующие проверки по недвижимости (поиск земельного кадастра, правовые и ипотечного проверки и т. д.). Он составляет акт, который подписывается в его присутствии, а затем он подает запросы на необходимые налоги и регистрирует право собственности земельного кадастра, в результате которого недвижимость официально становится собственностью покупателя.

Если Вы берёте в ипотеку, Вы будете подписывать отдельный акт на ипотеку в это же время, и нотариус зарегистрирует Ваш банк как Вашего ипотечного кредитора.

В момент подписания, Вы должны будете выплатить остаток от стоимости недвижимости, услуги нотариуса и соответствующие налоги.

НОТАРИАЛЬНЫЕ СБОРЫ

Нотариальные сборы отличаются, как правило, они составляют около 1,5% - 2% от покупной цены, но это всегда целесообразно запросить котировку. Однако, как, например, для дома стоимостью €100 000, оплата нотариусу может быть пределах около €1500 - €2000 (включая НДС). Если Вы берёте в ипотеку, Вы должны будете подписать два отдельных документа, поэтому стоимость будет в два раза больше.

Нотариус выбирается покупателем, однако он является независимым государственным должностным лицом. Он не может действовать в интересах одной партии, в ущерб другой. Having had a holiday home out in the countryside near Penne for ten years, we decided that it was now time for us to 'downshift' and move to a smaller, more easily managed house in town. Tracey had superbly managed the country house for us, arranging ongoing maintenance for the house and gardens, as well as successfully organising holiday lets for the weeks when we were not 'in residence'. Tracey is a highly respected professional; her knowledge and understanding of the vagaries of the property market in Abruzzo is second to none. Knowing her to be honest; always acting with integrity and with our best interests at heart, we were keen to involve her in our plans to relocate in Abruzzo, from the outset.

Tracey designed the advertisement for the sale of our property; posted it on her Abruzzoreality website and was successful in attracting a number of potential buyers. A sale and date for the exchange of contracts was agreed within weeks, meaning we had to quickly find a town house which met our needs. Tracey arranged for us to look at suitable properties in our preferred towns of Penne and Loreto Aprutino. Tracey chose well and we fell in love with a beautiful compact house in the 'Centro Storico' in Loreto. We made an offer which was accepted and through Tracey's hard work, were able to complete the purchase to coincide with the sale of our country property. Tracey had managed to successfully ensure our move was stress-free, seamless and relatively quick to conclude.

We will of course continue to use Tracey's management services for our new holiday home in Loreto and as always, will never hesitate to recommend 'Abruzzoreality' to anyone and everyone! After struggling to buy a house in Abruzzo for over a year, Abruzzo Reality made it happen for us. They turned out to be very helpful in ensuring we did not have any surprises and easing the, sometimes, arduous process of buying a house. They really pushed the boat out; sorting out difficulties with land boundaries and in particular, after purchase, they were very helpful in introducing us to a wide range of local craftsmen and builders to ensure we had a choice of who refurbished the property. While searching for our dream house in Italy, we “shortlisted” a long list of about 30 houses in various parts of Abruzzo. More than half of the houses were from Abruzzo Reality, as Tracey was one of the few real estate agents that responded to us, and promptly too. We met different real estate agents during our house-hunting trip. Tracey and Vincenzo stood out as they patiently listened to our requirements (and we were rather fussy about what we wanted!) and brought us to see the different houses. We read about the Daunting process of buying a house in Italy and different websites tell you different things. We were glad we could leave everything to Tracey and Vincenzo! They made the whole process so much easier as we had to go back to work and could not travel to Italy as often as we would have liked. After signing for our dream house, Tracey and Manolo (the do-it-all handyman) helped us with everything from cleaning the house, dealing with the utility company, to getting the house painted. We really appreciate their help!

To move, buy a house and live in another country with all its bureaucracy, customs and language barriers is quite a daunting, if not exciting, prospect at the best of times. To do so, when you are doing it alone can be frightening to say the least.

We entered into the Italian property market on a bit of a whim and with little knowledge. We would now regard Vincenzo and Tracey as our first Abruzzo friends. We often had meals together during our house hunting and we now take every opportunity to catch up with them when we return to the holiday home they found for us. We feel very lucky we stumbled on Abruzzo Reality!

We have moved from the USA to Montefino in the Province of Teramo, Abruzzo, Italy. By shear luck we googled Abruzzo properties and found Abruzzo Reality and Tracey! Property transactions are invariably by their very nature stress inducing, especially when involving an unfamiliar language and legal system. Complete trust in any company chosen for marketing and conveyancing is paramount and it was clear to me from my first conversation with Tracey that I had at last found the person I'd been looking for.

The sale of my property involved a particularly challenging problem which on several occasions appeared almost impossible to resolve. Tracey however is a person who inspires confidence almost as though failure is not an option and I have no doubt that without her skill and involvement the house would still be for sale and likely to stay that way.

Finding a house in Italy was no easy task as we had no idea of an area to choose, let alone a town or city!  After searching for a few months and following a couple of visits, we came across Tracey and Vincenzo through another agency we were viewing with, and after a very short space of time, we switched agencies. Tracey made buying a property in Abruzzo a quicker and easier process than buying property in the UK. We viewed in July and moved in November. She arranged appropriate viewings and was prepared to drive us to several properties with return visits when required. We stopped occasionally for coffee and pizza and a chat about the steps necessary, to make sure everything was done legally and ensure our peace of mind. Tracey is an invaluable link between non- Italian speakers and the authorities involved in buying here. She arranged Codice Fiscale's, bank accounts, money transfers, notaio's, geometra's etc and also arranged work we wanted done at the house before we moved in. She even personally cleaned the house before we moved in and bought us the essentials of at least wine to see us through the first night after a long drive from North Wales. Most communications were via email, always prompt, truthful and courteous. After we had moved in and during that very unsure period she was available by phone or email to help and support us when dealing with utility companies, Sky TV and practically anything we asked of her.
