De belangrijkste fasen van aankoop van onroerend goed (Compravendità) in Italië zijn de eerste aankoop aanbod (Proposta d'Acquisto), de voorlopig koopcontract (Compromesso), en de notariële slotakte van de verkoop (Rogito Notarile). Dit artikel legt uit hoe het proces werkt.

1. KOOPVOORSTEL (Proposta d’Acquisto)

De eerste stap na het vinden van het ideale huis is het maken van een koopvoorstel, geadresseerd aan de verkopende partij. Ook moet er een kleine aanbetaling worden gedaan, over het algemeen met een cheque, op naam van de verkoper. Deze wordt in bewaring gehouden door de makelaar.

De makelaar zal de juiste papieren in orde maken met alle punten en wensen in relatie tot de aankoop.

Als de verkopende partij het voorstel accepteert (zwart op wit), zijn beide partijen gebonden aan het voorstel en zal dit ten uitvoer worden gebracht. De verkoper zal de cheque incasseren die de makelaar in zijn bezit heeft. Dit wordt de aanbetaling op de aankoop van het onroerend goed (caparra confirmatoria).

Als de verkopende partij het voorstel niet accepteert, zal de makelaar de cheque weer retourneren. Vanaf dat moment bent u weer vrij om te gaan, of u kunt een ander voorstel doen met inachtneming van de procedure als hierboven beschreven.

OPMERKING:

  • Mocht u zich terugtrekken nadat het voorstel is geaccepteerd, bent u uw aanbetaling kwijt. Als anderzijds de verkoper zich terugtrekt nà het accepteren van het voorstel, moet hij hetzelfde bedrag betalen als boete.
  • Als er een voorstel wordt gedaan aan de verkopende partij, moet er altijd een een datum in staan voor de ondertekening van het voorlopige koopcontract en voor het definitieve koopcontract. Deze data worden gezien als uiterste datum. Eventueel eerder tekenen van de contracten kan wel, mits beide partijen het hierover eens zijn.
  • Het is niet verplicht om een aanbetaling te doen op het moment van het voorstel. Het laat wel de goede wil zien aan de verkopende partij. Aanbetalingen kunnen ook een onderdeel zijn van onderhandelingen en de manier van betalen

2. VOORLOPIG KOOPCONTRACT (Compromesso)

Het voorlopig koopcontract is een overeenkomst waarin beide partijen beloven in de toekomst het definitieve contract (Notariële akte) te tekenen, en waarin alle voorwaarden die zijn overeengekomen tussen beide partijen ten uitvoer worden gebracht.

In het voorlopig koopcontract moeten bepaalde zaken staan zoals de persoonlijke gegevens van beide partijen, de onderdelen en kadastrale gegevens van het onroerend goed, de prijs, de hoogte van de (aan) betalingen, de manier van betalen en de datum van de notariële akte. De eigenaar verklaart hier ook dat hij garant staat voor het volledig eigendom en verklaart dat het onroerend goed op het moment van de akte vrij zal zijn van hypotheken, aanspraken, derdenrechten, etc.

Een tweede aanbetaling moet tijdens de ondertekening van het voorlopige koopcontract worden gedaan. Dit is meestal rond de 20% van de overeengekomen prijs (inclusief de aanbetaling die reeds is betaald).

OPMERKING:

  • Wie onroerend goed koopt in Italië heeft een codice fiscale nodig. U kunt het beste zelf via het Italiaanse Consulaat in uw land een codice fiscale aanvragen. Eventueel kunnen wij het voor u aanvragen bij de lokale belastingdienst, mits u een postadres heeft in Italië. Wij hebben hiervoor een kopie van uw paspoort nodig, een aanvraagformulier met originele handtekening en een machtiging. Zonder een codice fiscale kunt u in Italië geen bankrekening openen.
  • Het is verstandig om zo snel mogelijk een bankrekening te openen zodat u daar het geld op kan storten voor de definitieve koopakte.
  • De makelaars courtage moet na het ondertekenen van het voorlopige koopkontract ook worden voldaan. De courtage ligt ongeveer rond de 3% van de aankoopprijs (+ VAT).

3. NOTARIËLE AKTE (Rogito Notarile)

De notariële akte is de definitieve akte en wordt ondertekend voor een publieke notaris (notaio) met beide partijen (koper en verkoper).

Voordat er wordt getekend, heeft de notaris de nodige zaken gecontroleerd van het onroerend goed, zoals de cadastrale gegevens, de legaliteit, of het onroerend goed vrij is van hypotheek of schulden aan derden etc. Nadat de akte is opgelezen wordt deze in het bijzijn van de notaris ondertekend en is de overdracht een feit. U bent de gelukkige bezitter van een eigen huis in Italië.

Mocht het zo zijn dat u voor de koop van het onroerend goed een hypotheek nodig heeft, dan zal er een aparte akte moeten worden getekend. Dit zal op hetzelfde moment gebeuren als de notariële akte. De notaris zal opnemen dat de bank de kredietverschaffer is van uw hypotheek.

Tijdens het tekenen van de akte zal ook de restbetaling van het onroerend goed moeten worden voldaan, alsmede het honorarium van de notaris en de verwante belastingen.

HONORARIUM NOTARIS

De honoraria van notarissen kunnen verschillen, maar liggen meestal tussen de 1,5% - 2% van de aankoop prijs. Het is wel aan te raden bij het uitzoeken van een notaris hier op te letten. Mocht u voor de aankoop van het onroerend goed een hypotheek nodig hebben, dan moeten er 2 akten worden getekend. De kosten zijn dan ongeveer dubbel.

BELASTINGEN

* Er is een minimum van € 1000 bij het betalen van de 2% belasting op een hoofdverblijfplaats. Als het goed is aangemerkt als een 'luxe', de belasting is 9%, niet 2%.

** als het goed is geclassificeerd een 'luxe', de belasting is 20%, niet 10%.

DE NOTARIS

De notaris wordt gekozen door de kopende partij. Hij is daarentegen een onpartijdig persoon en kan niet opkomen voor de belangen van één partij. De notaris draagt zorg voor het proces en verzamelt de benodigde gevens met betrekking tot de akte. De notaris moet ook nagaan of het onroerend goed vrij is van hypotheek, of de verkopende partij ook echt de eigenaar is etc. Het werk van de notaris is gegarandeerd. Mocht de notaris dus een fout maken, dan moet hij u schadeloosstellen voor alle verliezen die u oploopt.

OPMERKING:

  • Als het contract door twee privé personen wordt afgesloten, dan zegt de wet dat er in de akte het bedrag moet staan wat daadwerkelijk betaald is voor het onroerend goed. Echter, voor het berekenen van de belastingen wordt de kadastrale waarde (valore catastale) gebruikt. Deze waarde ligt over het algemeen een heel stuk lager dan de aankoop prijs.
  • Als de kopende partij de Italiaanse taal in woord en geschrift niet machtig is, dan zal de akte moeten worden vertaald. Een andere mogelijkheid is dat u een vertrouwens persoon machtigt (Procura) om namens u te tekenen. Deze persoon moet de Italiaanse taal in woord en geschrift machtig zijn.
  • Als u verhuist naar Italië en u verklaart bij de akte dat dit uw eerste huis is (prima casa), dan betaalt u minder belasting. U moet dan wel binnen 18 maanden vanaf de ondertekening van de akte uw residentie in Italië hebben. Op het moment dat u de akte ondertekent, mag u uiteraard nog wel een ander huis hebben, zolang u maar binnen 18 maanden de Italiaanse residentie heeft. Mocht dit niet het geval zijn, dan moet u alsnog de hogere belasting betalen, verhoogd met een boete.
  • Op 1 juli 2009 werd er een nieuwe wet van kracht, die zegt dat iedereen die zijn huis na deze datum verkoopt, moet zorgen voor de benodigde certificaten op het gebied van electra en gas. Dit moet gebeuren door een gecertificeerde specialist, en de verkopende partij moet hier zorg voor dragen.

INFO VAN ONS

Een huis kopen in Italië lijkt op het eerste gezicht heel erg gecompliceerd en bureaucratisch, maar is over het algemeen erg helder en duidelijk. Er worden veel risico’s uitgesloten omdat een notaris een zekere verantwoordelijkheid heeft ten opzichte van de kopende partij.

Het hele koop proces kan redelijk makkelijk worden doorlopen. Goede hulp en advies is daarbij belangrijk. Wij kunnen u helpen met het vinden van uw droomuis en het daaropvolgend traject. While searching for our dream house in Italy, we “shortlisted” a long list of about 30 houses in various parts of Abruzzo. More than half of the houses were from Abruzzo Reality, as Tracey was one of the few real estate agents that responded to us, and promptly too. We met different real estate agents during our house-hunting trip. I and my husband were thinking about buying a house or an apartment in Italy. Last October we visited a fair for Homes Abroad in Helsinki, Finland and afterwards we waited that one of the agency’s would contact us about the apartments.  Then, while we were on vacation at Christmas, we found in internet one apartment which was very interested. We first fell in love with Abruzzo when visiting friends in the summer of 2017. On return from our visit we began searching for a property. We spent many hours trawling through properties and estate agents on the internet!  Abruzzo Reality came highly recommended by some close personal friends.

Buying a house can be a stressful experience, even more so in a foreign country, but we can say without reservation that the whole process from beginning to end has been stress free.

We entered into the Italian property market on a bit of a whim and with little knowledge. Tracey immediately impressed us by the responsive way she answered our initial queries and provided us with really helpful advice on geographical areas to consider. We booked a couple of long weekends in Abruzzo and Tracey could not do enough for us in organising viewings and ferrying us from house to house. Tracey was accompanied by Vincenzo who originates from Abruzzo and together they make an impressive and knowledgeable Anglo-Italian partnership. Tracey held our hand throughout the process, arranging the survey and the notary and responding immediately to any issues whenever they arose. This high quality attentive service did not stop once we had taken possession of the property and Tracey continued to help out with organising energy supplies and fuel bills.

We would now regard Vincenzo and Tracey as our first Abruzzo friends. We often had meals together during our house hunting and we now take every opportunity to catch up with them when we return to the holiday home they found for us. We feel very lucky we stumbled on Abruzzo Reality!

To move, buy a house and live in another country with all its bureaucracy, customs and language barriers is quite a daunting, if not exciting, prospect at the best of times. To do so, when you are doing it alone can be frightening to say the least.

Finding a house in Italy was no easy task as we had no idea of an area to choose, let alone a town or city!  After searching for a few months and following a couple of visits, we came across Tracey and Vincenzo through another agency we were viewing with, and after a very short space of time, we switched agencies. We are 2 Danish families who recently has bought a house in Abruzzo.
